These Terms and Conditions apply to contracts for the temporary letting of the holiday homes “Anne Haus”, “Liese Haus” and “Anne + Liese Haus” (landlord: Sascha und Antje Pehl Grundstücksverwaltung GbR, Lüninghauser Str. 1b, 28865 Lilienthal) and of “Heideblüte”, “Heidelbeere”, “Glockenheide” and “Heideweg” (landlord: Heideweg GmbH, Lüninghauser Str. 1, 28865 Lilienthal) – each hereinafter referred to as the “landlord” – for accommodation purposes.
By submitting the online booking, the guest makes a binding offer. The contract is formed when the booking confirmation reaches the guest by email. The guest making the booking also books on behalf of everyone travelling with them and is responsible for their obligations.
The prices shown are per night and include utility costs, bed linen and towels, unless stated otherwise. The final cleaning fee is shown separately. Payment is made in accordance with the payment terms stated at the time of booking.
The house is ready from 15:00 on the day of arrival; on the day of departure it must be handed back by 11:00. Other times can be arranged.
The guest may cancel the contract at any time before arrival by giving notice to the landlord; what counts is when the notice is received (email is sufficient). Cancellation up to 30 days before arrival is free of charge. From the 29th day before arrival, 50 % of the accommodation price becomes payable as compensation; from the 7th day before arrival, and if the guest does not arrive, 90 %. The final cleaning fee is not charged in the event of a cancellation. Expenses saved and any income from letting the period to someone else are credited against this amount. The guest remains free to show that the landlord suffered no loss, or a substantially smaller one.
For contracts covering accommodation for purposes other than residential use which provide for a specific date or period, there is no right of withdrawal under § 312g(2) no. 9 of the German Civil Code (BGB). As our holiday homes are let solely for a firmly booked period, the guest has no statutory right of withdrawal. The contractual cancellation options under §5 remain unaffected.
The house may only be occupied by the number of people booked. All the houses are non-smoking. Pets are welcome if they are mentioned at the time of booking. Events and parties are not permitted; quiet hours from 22:00 to 7:00 must be observed. The guest will treat the house and its contents with care and report any damage without delay.
The landlord is liable without limitation for intent and gross negligence, and for damage arising from injury to life, body or health. Otherwise, liability is limited to the breach of essential contractual obligations and to foreseeable damage typical of this kind of contract. The guest is liable for damage culpably caused by them or by those travelling with them.
German law applies. Should individual provisions be invalid, the rest of the contract remains in force.
